Reese Marketos Wins Another Jury Verdict: Jury Awards Take-Nothing Verdict in Favor of Defendant WatchGuard Video in Patent Infringement Suit in the Eastern District of Texas.


Sherman, Texas, July 14, 2017: A jury in the patent infringement case in the United States District Court for the Eastern District of Texas returned a unanimous verdict in favor of Defendant WatchGuard Video, a leading provider of video surveillance technology for law enforcement agencies.

Adam Sanderson and Tyler Bexley from the litigation boutique, Reese Marketos LLP, represented WatchGuard at trial.

“We believed from the beginning that once the jury heard our evidence, it would agree that WatchGuard’s products do not infringe and at least one Evicam’s patents would be found invalid,” said Adam Sanderson, a trial attorney who specializes in representing software companies and inventors in patent and commercial lawsuits. “We are all happy with the jury’s decision.”

Plaintiff Evicam International, Inc. alleged that WatchGuard’s 4RE and DV-1 in-car video systems infringed two of Evicam’s patents, namely, U.S. Patent No. 6,211,907 (the ‘907 Patent) and U.S. Patent No. 6,950,013.

Following a five-day trial, the jury determined that WatchGuard’s products do not infringe any of the asserted patent claims brought by Evicam. The jury further decided that the asserted claims from the ‘907 Patent were invalid.

Before trial, Evicam had sought more than $15 million in damages, which Evicam reduced to $10.4 million during trial. On July 17, 2017, the Court entered a Final Judgment on the verdict, dismissing all of Evicam’s claims. “WatchGuard is an innovative company that employs the best engineers and relies on its own technology for a competitive advantage, so we are pleased that the jury sided with us on every question presented at trial,” said Tyler Bexley.

Reese Marketos wins preliminary injunction freezing assets of judgment debtor


A judge in the U.S. District Court for the District of Nevada issued a preliminary injunction freezing the assets of a judgment debtor and his affiliated entities. The injunction is the latest step in Reese Marketos’s efforts to collect on a multimillion-dollar RICO judgment won by Pete Marketos. The case is currently on appeal to the United States Court of Appeals for the Ninth Circuit, with questions of law certified to the Nevada Supreme Court. In TGI Friday’s v. CBIF Limited Partnership, the Fifth District Court of Appeals denies rehearing and affirms Reese Marketos’s trial win, which resulted in the judicial dissolution of the partnership that owned the TGI Friday’s restaurants at DFW International Airport when one of its partners refused to amend the partnership agreement to comply with Federal law regarding minority owned businesses.

Reese Marketos wins $2.3 million judgment following arbitration award


After winning $2.3 million in a private arbitration on March 2017, Reese Marketos recovered a Final Judgment from a Tarrant County district court in connection the arbitration. Reese Marketos represented a trucking company who sued a highway contractor in connection with a massive highway project in Northern Tarrant County. The trucking company received all of the damages it requested in the arbitration plus 18 percent pre- and post-arbitration interest.

Reese Marketos wins procedural victory on behalf of New York Attorney General in climate change litigation


Reese Marketos prevailed in transferring the highly-publicized climate change litigation filed by ExxonMobil against the state attorneys general for New York and Massachusetts. RGM represented New York Attorney General Eric Schneiderman in the Texas litigation. US District Judge Ed Kinkeade transferred the Texas litigation to New York, which effectively ended the Texas litigation.

The Texas Supreme Court issued what legal commentators have called 40-page treatise on the law of nuisance in Crosstex North Texas Pipeline v. Gardiner. Reese Marketos was lead counsel on the appeal for landowners, the Gardiners. The Texas Supreme Court redefined the law of real property nuisance.

HMS Holdings Corp. (NASDAQ: HMSY) announced its settlement with Public Consulting Group, Inc. of lawsuits in Texas and New York. Reese Marketos represented HMS as lead counsel in widely publicized litigation in New York and Texas. In a press release issued by HMS, HMS Chairman and CEO Bill Lucia stated that the objectives of the litigation—to defend HMS’s intellectual property and to protect its trade secrets—have been accomplished.

Partner Adam Sanderson and Associate Leslie Chaggaris were named 2015 Rising Stars by Super Lawyer Magazine. The Rising Stars designation recognizes the state’s top up-and-coming attorneys under the age of 40 or in practice for 10 years or less. The selection process for Rising Stars is entirely peer nominated and reviewed. UPS liable for client’s litigation costs


The Court enters a $6.4 Million judgment in favor of the Rankin Family including damages plus attorneys’ fees. UPS had invoked the formal “Offer of Settlement” procedure, offering to settle all claims for only $300,000. The Rankins rejected that offer and invoked the procedure themselves by making a counteroffer that UPS rejected. Because the judgment against UPS was significantly less favorable than the Rankins’ offer of settlement, UPS was liable for the Rankins’ litigation costs, including their attorney fees.

Partner Pete Marketos won a five million dollar verdict against UPS


Reese Marketos Partner Pete Marketos, along with The Perrin Law Firm, won a $5,000,000 jury verdict against UPS on behalf of their clients, the Rankin Family. Scott Rankin was cycling on a country road outside of Boerne, Texas, when he collided with a UPS truck in broad daylight. The collision broke Mr. Rankin’s neck and rendered him a quadriplegic. Mr. Rankin, who was 37 at the time of the accident, is a husband and father of three young children. Click here to see the jury’s verdict.

Associate Kendal Simpson’s argument highlighted in Texas Lawbook and Dallas Morning News


On Wednesday, March 6, 2013, Reese Marketos associate Kendal Simpson argued before the Fifth Circuit Court of Appeals in defense of a summary judgment that Reese Marketos partners Joel Reese and Brad Gordon, with Kendal’s help, obtained in federal district court. The summary judgment denied all the claims of T. Boone Pickens and Oklahoma State University against Reese Marketos’s clients and other defendants in a case in which Pickens and OSU sought more than $33 million in damages. The case was highly publicized, and Kendal’s sterling argument was highlighted in the Texas Lawbook and the Dallas Morning News.

A unanimous jury found for Reese Marketos client Cardenas Metroplex—a Mercedes-Benz dealership in Harlingen, Texas owned by Renato Cardenas, Sr.—on all counts, awarding more than $21 million in actual damages for fraud and misrepresentation and further finding, beyond a reasonable doubt, that Mercedes-Benz had caused Cardenas to execute a document through deception—a felony crime under the Texas Penal Code. The trial court further instructed the jury that Mercedes-Benz had destroyed, lost, or failed to produce material evidence in the case. The jury awarded $100 million in punitive damages against Mercedes-Benz, $10 million in punitive damages against its Chicago-based Regional Franchise Manager, and $2.5 million in punitive damages against each of two Mercedes-Benz field representatives.

Securities fraud lawsuit filed against Nuance Communications


On November 1, 2012, Reese Marketos filed a securities fraud lawsuit against Nuance Communications in connection with a $45 million acquisition of a privately held software company. Reese Marketos’s clients seek more than $20 million in damages from Nuance after an arbitration panel found that Nuance fraudulently induced the former stockholders in the software company into a merger agreement.

Reese Marketos’s representation of certain defendants in a case against T. Boone Pickens and Oklahoma State University was highlighted in a recent Wall Street Journal article entitled “Boone Calls the Plays as Largess Complicates Life at Alma Mater.” The front-page story discusses the facts surrounding a pair of cases involving Boone Pickens and includes quotes of deposition testimony taken by Reese Marketos partner Joel Reese. Reese Marketos was successful in getting all claims filed by Boone Pickens against Reese Marketos’s clients dismissed through motions for summary judgment in federal court.
