RM Successfully Defends Out-Of-State Municipalities and Officials Against Exxon Mobil Corp.
California municipalities and officials sought to hold Exxon responsible for infastructure damage related to climate-change through various nuisance causes of action filed in California. Exxon retaliated by seeking pre-suit discovery of a “conspiracy” against Exxon to allegedly suppress its right to “political speech” relating to fossil fuels. Pete Marketos and Tyler Bexley represented the California officials and municipalities and successfully halted Exxon’s attempt, arguing that personal jurisdiction was lacking in Texas. The Second Court of Appeals in Fort Worth begrudgingly agreed, stating that public comments allegedly directed at Texas-based Exxon do not create sufficient contacts with Texas to establish personal jurisdiction over the California parties to the suit. Preliminary Injunction Against RM Client Molson Coors is Denied; Now Pending Appeal
Pete Marketos and Brett Rosenthal, alongside counsel from Crowell & Moring LLP, successfully defended Molson Coors in a lawsuit seeking to stop the beverage company from marketing and selling “Vizzy,” a new hard seltzer product. Future Proof sells a hard seltzer product called “Brizzy” and claims the similar names cause consumer confusion. The judge denied Future Proof’s request for a preliminary injunction, reasoning that the seltzers are inspired by the generic term “fizzy” and that Future Proof lacked sufficient evidence of customer confusion. Future Proof is now appealing to the Fifth Circuit, asking the court to overturn the ruling. For more on the ruling, click here.

Joel Reese and RM Team Procure Impressive Settlement Against Shell Trading Co.
Partners Joel Reese and Leslie Chaggaris led a team of Reese Marketos lawyers representing client Jamex Marketing, LLC, in related lawsuits against Shell Trading Co. and Whiting Petroleum Corp. Jamex alleged tortious interference and breach of contract claims relating to a $50 million oil transportation contract between Jamex and Shell, which Shell terminated only 5 months into its 7-year term. Jamex claims that Whiting and Shell conspired together to bring about the wrongful termination so that Whiting could receive the transportation fees that should have gone to Jamex pursuant to the terms of the contract.
Mr. Reese is “extremely pleased” with the terms, which require Shell to pay $13.85 million to Jamex in order to bring an end to the pending lawsuits. Jamex received approximately $8,060,000 net of attorneys’ fees and expenses.

RM Secures Ruling That Copyright Infringement Case May Go Forward Against Governmental Entity
A Texas federal judge recently ruled that the University of Texas Medical Branch (UTMB) could not assert a claim of sovereign immunity or refer the case to an administrative hearing to escape a lawsuit claiming copyright infringement and seeking injunctive relief.
Pete Marketos, Tyler Bexley, and Josh Russ represent KaZee, Inc. in a lawsuit seeking an injunction against UTMB for unauthorized use of a medical records software program. UTMB admittedly exceeded the scope of a license between the parties regarding use of the program but asserted that sovereign immunity applies because the claims grow from a breach of contract claim that has not been adjudicated.
The RM lawyers successfully argued that an exception from sovereign immunity applies because the current lawsuit only seeks injunctive relief from ongoing use. The parties will now move forward with a hearing on KaZee’s motion for a preliminary injunction.

RM Successfully Defeats Two Patent Validity Challenges before the Patent Trial and Appeals Board.
Adam Sanderson defeated two, separate petitions for Inter Partes Review (IPR), both of which were filed by one of the nation’s largest media and cable television companies. Mr. Sanderson’s client is the owner of U.S. Patent No. 8,656,431, a technology relating to the delivery and organization of streaming video television programming. An IPR is a third-party challenge to a patent’s validity and is heard before the Patent Trial and Appeals Board (PTAB) at the United States Patent and Trademark Office (USPTO). To determine whether either petition for IPR could be heard on a substantive basis, the PTAB had to first decide whether there was a sufficient legal basis to “institute.” The PTAB determined, based on the arguments and evidence presented by Mr. Sanderson and the RM team, that there was “not a reasonable likelihood that Petitioner would prevail in showing at least one of the challenged claims is unpatentable.” Based on these rulings, the PTAB declined institution and the patent remains valid. Josh Russ Returns to RM
Reese Marketos is thrilled to announce the return of Josh Russ to the firm. Josh left Reese Marketos in 2015 to join the United States Attorney’s Office for the Eastern District of Texas as the Eastern District’s Affirmative Civil Enforcement Coordinator. Josh also served as the Eastern District’s Civil Healthcare Fraud Coordinator. In 2018, Josh was promoted to serve as the Eastern District’s Civil Chief where he supervised all civil litigation across the six districts of the Eastern District. During his time with the U.S. Attorney’s Office, Josh played a pivotal role in fighting healthcare fraud as well as the nation’s opioid crisis. Josh returned to Reese Marketos in November of 2019 as a partner where he will lead the firm’s Eastern District office and its False Claims Act practice.

Adam Sanderson of RM Convinces Court to Permit Infringement Suit to Move Forward Against Comcast
Reese Marketos Partner Adam Sanderson represents WhereverTV in an infringement lawsuit against Comcast, alleging that Comcast is infringing on WhereverTV’s Xfinity media platform. Comcast attempted to have the lawsuit put on hold while the U.S. Patent and Trademark Office reviews the patent at issue. The U.S. District Court in Florida refused Comcast’s request for a stay, permitting the lawsuit to move forward. The Court agreed that it would be prejudicial to WhereverTV to put a hold on the case now, with extensive discovery and trial preparation already well underway. Reese Marketos Wins Another Jury Verdict: Jury Awards Take-Nothing Verdict in Favor of Defendant WatchGuard Video in Patent Infringement Suit in the Eastern District of Texas.
Sherman, Texas, July 14, 2017: A jury in the patent infringement case in the United States District Court for the Eastern District of Texas returned a unanimous verdict in favor of Defendant WatchGuard Video, a leading provider of video surveillance technology for law enforcement agencies.
Adam Sanderson and Tyler Bexley from the litigation boutique, Reese Marketos LLP, represented WatchGuard at trial.
“We believed from the beginning that once the jury heard our evidence, it would agree that WatchGuard’s products do not infringe and at least one Evicam’s patents would be found invalid,” said Adam Sanderson, a trial attorney who specializes in representing software companies and inventors in patent and commercial lawsuits. “We are all happy with the jury’s decision.”
Plaintiff Evicam International, Inc. alleged that WatchGuard’s 4RE and DV-1 in-car video systems infringed two of Evicam’s patents, namely, U.S. Patent No. 6,211,907 (the ‘907 Patent) and U.S. Patent No. 6,950,013.
Following a five-day trial, the jury determined that WatchGuard’s products do not infringe any of the asserted patent claims brought by Evicam. The jury further decided that the asserted claims from the ‘907 Patent were invalid.
Before trial, Evicam had sought more than $15 million in damages, which Evicam reduced to $10.4 million during trial. On July 17, 2017, the Court entered a Final Judgment on the verdict, dismissing all of Evicam’s claims. “WatchGuard is an innovative company that employs the best engineers and relies on its own technology for a competitive advantage, so we are pleased that the jury sided with us on every question presented at trial,” said Tyler Bexley.

Reese Marketos wins $2.3 million judgment following arbitration award
After winning $2.3 million in a private arbitration on March 2017, Reese Marketos recovered a Final Judgment from a Tarrant County district court in connection the arbitration. Reese Marketos represented a trucking company who sued a highway contractor in connection with a massive highway project in Northern Tarrant County. The trucking company received all of the damages it requested in the arbitration plus 18 percent pre- and post-arbitration interest.

Reese Marketos prevailed in transferring the highly-publicized climate change litigation filed by ExxonMobil against the state attorneys general for New York and Massachusetts. RM represented New York Attorney General Eric Schneiderman in the Texas litigation. US District Judge Ed Kinkeade transferred the Texas litigation to New York, which effectively ended the Texas litigation.

Partner Pete Marketos wins verdict against UPS
Reese Marketos Partner Pete Marketos, along with The Perrin Law Firm, won a negligence jury verdict against UPS on behalf of their clients, the Rankin Family. Scott Rankin was cycling on a country road outside of Boerne, Texas, when he collided with a UPS truck in broad daylight. The collision broke Mr. Rankin’s neck and rendered him a quadriplegic. A unanimous jury found for Reese Marketos client Cardenas Metroplex—a Mercedes-Benz dealership in Harlingen, Texas owned by Renato Cardenas, Sr.—on all counts, awarding actual damages for fraud and misrepresentation and further finding, beyond a reasonable doubt, that Mercedes-Benz had caused Cardenas to execute a document through deception—a felony crime under the Texas Penal Code. The trial court further instructed the jury that Mercedes-Benz had destroyed, lost, or failed to produce material evidence in the case. The jury awarded punitive damages against Mercedes-Benz, its Chicago-based Regional Franchise Manager, and each of two Mercedes-Benz field representatives.

Securities fraud lawsuit filed against Nuance Communications
On November 1, 2012, Reese Marketos filed a securities fraud lawsuit against Nuance Communications in connection with a $45 million acquisition of a privately held software company. Reese Marketos’s clients seek more than $20 million in damages from Nuance after an arbitration panel found that Nuance fraudulently induced the former stockholders in the software company into a merger agreement.

Defense case highlighted in Wall Street Journal
Reese Marketos’s representation of certain defendants in a case against T. Boone Pickens and Oklahoma State University was highlighted in a recent Wall Street Journal article entitled “Boone Calls the Plays as Largess Complicates Life at Alma Mater.” The front-page story discusses the facts surrounding a pair of cases involving Boone Pickens and includes quotes of deposition testimony taken by Reese Marketos partner Joel Reese. Reese Marketos was successful in getting all claims filed by Boone Pickens against Reese Marketos’s clients dismissed through motions for summary judgment in federal court.

Joel Reese, Brad Gordon, and Kendal Simpson prevailed in publicized lawsuit
Partners Joel Reese and Brad Gordon, along with associate Kendal Simpson, prevailed in a much publicized lawsuit against Boone Pickens. On March 9, 2012, U.S. District Judge Jorge Solis granted the motion for summary judgment filed by Reese Marketos team, ending a more than two year lawsuit where Mr. Pickens and Cowboy Athletics sought more than $33,000,000 in damages.
